When Mark assisted with the Lundy appeal in 2017, his primary focus was ensuring that the Crown filed all of its submissions, and provided all of its documents, in accordance with the Court of Appeal - Criminal Electronic Document Protocol (17 April 2016). Mark had spent a number of years working in Information Technology before making the transition to law. His previous experience in that area meant following and understanding the protocol came natural to him. Even though the electronic document management of the Lundy appeal was a massive task, especially for his flagship electronic document appeal, it ran flawlessly. Philip Morgan QC was lead counsel at the appeal, and in a first for him, he arrived at the Court of Appeal with one eastlight folder and his laptop. Ben Vanderkolk and Mark both assisted Mr Morgan QC and followed the appeal electronically.
Since Lundy, Mark has assisted Mr Morgan QC with a number of other appeals. Essentially once submissions are finalised and filed Mark takes those written submissions and converts them to suit the Criminal Electronic Document Protocol. Once converted to an electronic form, the electronic submissions, with authorities, are filed with the registry. Up until April 2018 the filing of electronic documents has been fulfilled by providing the electronic documents to the registry and relying on the registrar to set up the Electronic Casebook and test it. As of April 2018, the Court of Appeal is running an Electronic Filing Pilot using the Courts Case Portal for the automatic filing of electronic documents. Mark was invited to participate in the Pilot and will be filing all future appeal that way.
Mark is now offering his services to other firms and barristers that wish to file proceedings or appeals using an electronic casebook. One word of advice, engage someone early to assist.

It is best to get in touch as early as possible. There are certain things you can do right from the start of your engagement which will assist in filing electronically.
He assists right from drafting of submissions through to filing. He oversees the document management which is a large part of any appeal, especially civil and common bundles. Once the submissions are in order he finalises all the footnotes in accordance with the Electronic Document Protocol and then hyperlinks all those footnotes to their relative document. Once the submissions are finalised and hyperlinked he assists with the electronic filing of the casebook.
